Terms and Conditions
TERMS AND CONDITIONS


IN GENERAL

1. Purpose
The purpose of this Terms and Conditions is for setting forth conditions and procedures of use, and other guidelines applicable to Internet service(the "Service") that the web site of Hanol Technology Inc.(the "Company") provides. 

2. Effect and Modification 
1) The provisions of the Terms and Conditions will come into effect by announcing to you in a bulletin or other ways. 
2) The Company has the right to modify the Terms and Conditions for any reason, and the Company shall announce the modification within at least seven days by ways like the guideline 1) above.     
3) Unless explicitly stated otherwise, the new service of the Company web site will be provided according to the Terms and Conditions. 

3. Other Standing Law
The clauses which are not stated in the Terms and Conditions shall be governed by rules of the Basic Telecommunication Law, the Telecommunication Business Law and other related laws of Republic of Korea.

4. Definition 
The definitions used for the Terms and Conditions are as follows.

1) Member(user) : Any individual or corporation, or organization equivalent to the corporation that made an membership agreement with the Company.
2) ID      : Combination of letters and numbers which a member decides and which the Company approve for the identification of the member and the service for the member.
3) Password : Combination of letters and numbers which a member decides for the member's confidentiality.
4) Hanol Money: Virtual money available at the paying for the use of software the Company provides.
5) Suspension of the Service : To suspend offering service in use for a period of time according to the condition the Company requested.
6) Termination  :  Cancellation of user agreement between the Company and a member in the Service.


USER AGREEMENT

5. Conclusion of User Agreement
If you check " I have read and agree to above terms and conditions" check box below and also click the "Sign Up" button, you agree to the Terms and Conditions. This is the same as the Terms and Conditions are modified, and you are able to cancel the membership registration when you disagree to the modified Terms and Conditions.

6. Registration and Acceptance
1) By filling out the registration form and submitting it at the 'Membership Registration', you are being registered. 
2) When the Company accepts the registration, the user agreement comes into effect.
3) The Company can restrict the acceptance of the registration to the following cases and withhold the acceptance until the cases resolve.
1> Insufficient facility capacity related to the Service.
2> Technical problem.
3> Other inevitable problems.

4) You agree to comply with the following.
1> You should write your accurate name in the registration form.
2> You should not use another's name in the form.
3> Your information of the registration form must be current.
4> You should not register in order to invade publicity rights, or conduct what is publicly harmful.
5> In case the registration form or the information of it alters, you should update the data that will be true, accurate, current and complete.
6> If you provide any information that is untrue, inaccurate, not current or incomplete, or the Company has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, the Company has the right to restrict or terminate your use of the Service.

5) If anyone under the age of 20 needs to use the Service, the Company will require verified parental consent. 

7. Change of Member ID 
1) The Company has an authority to require a change of your member ID to the following cases, or the Company can change the ID by the request of you.
1> In case the registration information has any possibility to invade your privacy by including phone number, or other identifiable information.
2> Hateful conduct and harmfulness to the public.
3> In case of the Company's own reasonable grounds.

2) The registered member ID shall not change and the same person shall not have multiple IDs.
3) You can use the paying service when you use only one ID for one computer.

8. Consent to Sharing Personal Information
1) The Company uses your personal information required in the registration form in order to fulfill this Terms and Conditions and offer the Service.
2) The personal information can be offered to the Company and its trusted partners for your convenient use of the Service the Company and its partner offer. In this event, the Company will let you know about it in advance and the Company can cancel your registration if you do not accept the announcement. But if you keep using the Service, we consider you accept the announcement. 
3) The personal information can be offered, in case of a request by government organization in compliance with legislation such as the Telecommunication Business Law, or in case of an investigating purpose, or in case of a request by the Information Communication Ethics Committee, or a request for information in compliance with processes of related laws.
4) The Company can collect statistical data about some or all members' personal information and use them related to the business, or offer them to any other organization.   
5) You can always check your own personal information, and modify the information. If you do not accept the contents of the Terms and Conditions and cancel your registration, the Company will remove your personal information.
6) The Company can transfer a cookie to your computer via the Service. You can change your Web browser in order to reject a receipt of the cookie or warn of it. 


USE OF THE SERVICE

9. Service Hour
1) The Company opens the Service instantly after the Company's acceptance of your registration. But if the Company do not open the Service due to the Company's occupational or technical problem, the Company will announce it in a bulletin or let you know about it immediately.
2) Basically the Service hour is 24 hours a day as open through out the year. But all or some of the Service can be discontinued for a while due to an occupational or technical reason, or the Service can be discontinued for a while in a period that the Company fixed for the purpose of an operational reason. In the event, the Company will let you know about it before or after.
3) The company can fix an available time for each service separately and the Company will let you know about it in advance.

10. Description of Service
You can access the Company's web site information and download a necessary software even if you do not register. However you can use the downloaded software for pay when you are a registered member. 
 
11. Payment
1) The Company's Service is basically for free. But in case of the paid service such as using the Company providing software, it can be available to you when you pay the charge mentioned in related service.
2) The payment for the paying service can be done through purchasing Hanol Money, or through monthly charging(post payment system, After-Payment). 
3) You can purchase Hanol Money by credit card payment according to the guidelines of an electronic billing company associated with the Company. But the Company can save up a certain amount of Hanol Money for free in the special event like membership congratulation.
4) In order to use After-payment system, you should submit the "Payment Agreement Form" after signing on it in order for the Company to charge for using the Service.
5) After-payment member should pay the money by credit card after the Company charges for it.  For the unpaid user of previous bill, the Company can restrict using the charged service until the bill is paid.  

12. Information Providing & Advertisement
1) With respect to an application of the Service, the Company can post advertisements in spots the Company specified such as a bulletin, homepage, E-mail, etc.
2) You are not allowed to delete, slander, or disturb the homepage banner advertisement that the Company offers.
3) The Company can provide information by advertising in a bulletin or whatever regarding the Service.

13. Delete of bulletin or contents
The Company can modify or delete a bulletin or contents without any prior notice or consent in case of the violation of rules, overdue of the posting period.

14. Discontinuance of Service
For free service, the Company can always modify or discontinue all or some of the Service in the Company's sole discretion. In this event, immediately the Company will let you know about it via E-mail or homepage.


RIGHTS AND OBLIGATIONS

15. Obligations of the Company
1) As far as the Company has no special occasion, it should always maintain the Service offer system as applicable, and should try the best for a secure service.
2) The Company should immediately settle user's complaints concerning the Service. If it's not possible, the Company should inform the user of the reason and the settlement schedule via a bulletin or E-mail.  

16. Obligations of Members
1) You should comply with related laws, rules of the Terms and Conditions, any guidelines, and notification in a bulletin or whatever, and you are not allowed to disturb the Company's business.
2) You are not allowed to make any commercial use of the Service without the Company's permission, and also you can not spread or post illegal information.
3) You are responsible for maintaining the confidentiality of your password and ID, and are fully responsible for all activities that occur under your password or ID. You should not allow third party to use your password and ID. If you acknowledge that your password or ID are stolen or used by third party, you should inform the Company of it.
4) You are not allowed to exploit or distribute information from the Service through reproduction, transfer, modification, translation, publication, broadcast, advertisement, sell, etc. The Company are not responsible for any losses or damages of any kind incurred as a result of those activities, but you are responsible for the losses and damages that the Company claims.
5) You are not allowed to use the Service to:
1> Upload, post, E-mil, transmit or post links to any content that is unlawful, harmful, obscene;
2> Invade another's privacy or publicity rights, intellectual property rights;
3> Conduct hacking or spread computer viruses, or transmit any unsolicited or unauthorized advertising, promotional materials, "spam," "chain letters,";
4> Exploit other user's ID;
5> Collect or store personally identifying information about other users;
6> Impersonate or misrepresent any person including any official or employee in the Company;
7> Manipulate any sender's name of any content transmitted through the Service;
8> "Stalk" or otherwise harass another;
9> Conduct anything that is offensive to the Service, or illegal to the related laws;

17. Prohibition of Transfer
You are not allowed to transfer, donate your right on the Service, your status of the user agreement to others, and also offer them as guarantee.

18. Termination and Restrictions
1) The Company may terminate your access to the Service when you fail to comply with the Terms and Conditions, with or without prior notice.
2) In case the user of guideline 1) above would like to register again, the Company can delay an acceptance for a period of time.
3) If you would like to terminate the membership agreement, you are able to do it on the Company's web site. In this case, anyone can have your ID. However the Hanol money left won't get back to you and will get to the Company. Also you are responsible for paying money left from After-payment service despite your termination.

19. Indemnity
1) The free service of the Company is not included in the indemnity categories.
2) If any losses or damages arise from the irresistible like natural disasters, or by your intention or your fault, the Company does not indemnify for the losses or damages.
3) For the paying Service, you can be compensated according to the each indemnity rule from each service.

20. Limitation of Liability
1) You agree that the Company shall not be liable for any losses, damages and dispute resulting from the use of the Company's software, because the software is for reference.
2) You agree that the Company shall not be liable to interrupt for any dispute between users or between a user and a third party and also for damages incurred by them.
3) The Company shall be exempted from a liability when a problem occurred by user's fault or failure in use of the Service.
4) In case any losses or damages happen to the Company due to user's violation of the Terms and Conditions, the user should indemnify the losses and damages and exempt the Company from such losses and damages.

21. Settlement of Dispute
1) The Company and user should make every effort to settle a dispute between them related to the Service.
2) If a lawsuit is filed for all the efforts, the dispute will be committed to the related court indicated in the Code of Civil Procedure.

22. Governing Law
Any claim or cause of action arising out of use of the Service shall be governed by the related laws of the Republic of Korea
